If you order a product on our website, you accept the following conditions. These conditions are subject to change at any time, it is your responsibility to check these terms before ordering products in case there are any changes.

Pricing

All orders are subject to acceptance and item availability. The price of each item is correct when you order but Exmoor Caviar reserve the right to change the price without notice.

Availability

All our products are available subject to availability and seasonality. For certain specialist products, we will need 2-3 days notice so that we can source the product fresh for you, before delivering to your door.

 

Normally, all products shown on the website are available and will be delivered within 24 hours, (if ordered before 12pm Monday to Thursday, delivered Tuesday if ordered at other times) however if there is a problem with the availability of an item, Exmoor Caviar will endeavour to send you an e-mail or reach you by telephone to inform you. Should a substitute be available we will add this to your order subject your approval, however if we cannot contact you we will send the original order without the out of stock item.

Refunded Items

Items displayed on the website may occasionally be unavailable and/or may be out of stock. A full refund will be made if we are unable to deliver your product(s) and/or service(s). The refund will only be for the price of the product and/or service. Our liability for any transaction will not be greater than the price charged for the product(s) and/or service(s) pertaining to the transaction in question.

Your Information

You guarantee that the information given on your order form is complete and accurate.

Order Acknowledgement

Once your order is completed, we will send you an email confirmation of your order. We will confirm the product you ordered, the quantity you ordered, the price, applicable VAT, applicable shipping & postage charges and delivery address. If we are unable to accept your order, we will contact you to inform you of this and provide you with the reason for our being unable to accept your order. We aim to do this in a timely manner.

Legal Jurisdiction

Any commercial dealings or contracts entered into with Exmoor Caviar and the Terms & Conditions of Trade contained herein, shall be governed by English Law. Any disputes which may arise are subject to English Law and shall be addressed and decided exclusively by the courts of England.

Data Protection

Exmoor Caviar values your custom and ethics behind your privacy. You have the right to know how your information is utilised. The data that we receive when providing you with our services is the information that you voluntarily provide (usually upon ordering online or over the phone), and the information through email communications (with regards to an ongoing order and/or email marketing). We also contract with other companies to facilitate our services such as delivery companies such as DPD and Royal Mail and an external telephone answering service (Answer 4 You) that are all GDPR compliant. This is in the sole purpose of the fundamental operations of our online business. In the case that you do not want to receive promotional offers, you may unsubscribe on the respective GDPR email received. Finally, we use ‘cookies’ which allows us to track search preferences, this does not store any personal data, however you may disable upon entering our website.

 

Data collected once you have made a purchase will be kept to ensure that we are providing you with the best possible shopping experience it also helps if you are a returning customer. We confirm that are website operates under secure HTTP protocol. You may at any time update your personal information. Upon consent on the checkout page we will keep your data for a maximum period of 5 years as we want to facilitate your shopping experience over time. This period will also facilitate returning customers and enable us to back track any query you may have on a previous order.

 

By accepting our Privacy policy upon check out you give us your consent to store this data. In the eventual case that you do not want us to store this information, please send an email to info@exmoorcaviar.com. In this case we would keep your information for a maximum of 3 months upon delivery of your order. This period is justified in the eventual case that there would be any type of issue with your order based on our products minimum shelf life (this excludes our fresh products).  Finally, you also have the possibility to request for all information and data to be deleted, providing you do not have an ongoing order as this may impact our services provided to you.

Payment

​All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

Returns

If you want to return a product because you are not satisfied, please call our sales department.

Images and Graphic Depictions

Images on our website are intended for guidance only and are not necessarily displayed to scale or exact colour definition. Graphic depictions may not, therefore, be identical to actual products and should be used for general guidance only.

Delivery

Delivery is designed to take place within one working day from the day of placing the order, except where an order is placed on a Friday, Bank Holiday, Saturday or Sunday. When an order is placed on a Friday or non-working day, delivery is designed to take place on the second working day following the placing of an order.

 

Someone MUST be at the address of delivery to receive the parcel - delivery times are anytime between 9 - 5pm or anytime before 12pm. We do not accept any responsibility for the state of a parcel that is sent back to a courier depot due to a recipient not being at the shipment address.

Please note that Exmoor Caviar does note accept responsibility for third party delivery of the products that you order. From time to time products may not arrive on time as requested. This is not the responsibility of Exmoor Caviar but we will always strive to find a solution to any issues that may arise.

Perishable Food Excluded from 'Cooling-Off' Period

The perishable foods we sell on this website are excluded from your statutory right to withdraw purchases within the seven working day 'cooling-off' period. The cooling off period does not apply to perishable food items.
